Code of Conduct
Effective date: March 2026
This Code of Conduct governs the behaviour and ethical obligations of all participants on the iResolve.legal platform, including claimants, respondents, and mediators. By using the platform, all parties agree to abide by these standards.
1. General Principles
All participants shall:
- Act in good faith and with honesty throughout the dispute resolution process.
- Treat all other participants with respect and dignity.
- Refrain from abusive, threatening, or discriminatory language or behaviour.
- Comply with all applicable laws, including the Mediation Act, 2023, and the Information Technology Act, 2000.
2. Mediator Ethics
Mediators empanelled on iResolve.legal shall:
- Impartiality: Remain neutral and impartial at all times. A mediator shall not favour either party or have any personal interest in the outcome of the mediation.
- Competence: Possess adequate training, qualifications, and experience in mediation. Mediators shall only accept cases within their area of competence.
- Confidentiality: Maintain strict confidentiality of all information disclosed during mediation. No details of the mediation proceedings shall be disclosed to any third party without the written consent of both parties.
- Conflict of Interest: Disclose any existing or potential conflict of interest immediately upon becoming aware of it. If a conflict exists, the mediator shall recuse themselves from the case.
- Informed Consent: Ensure that all parties understand the mediation process, their rights, and the voluntary nature of participation before commencing sessions.
- Professional Boundaries: Refrain from providing legal advice to either party. Mediators facilitate resolution; they do not act as judges, arbitrators, or legal counsel.
3. Conduct During Sessions
During mediation sessions, all participants shall:
- Join sessions on time and be prepared with relevant information and documents.
- Allow each party to speak without interruption.
- Focus on resolving the dispute constructively rather than escalating conflict.
- Maintain a professional environment — sessions conducted via video shall follow standard professional norms (appropriate attire, quiet environment, stable connectivity).
- Not record, screenshot, or otherwise capture mediation proceedings without the express consent of all participants and the mediator.
4. Confidentiality Obligations
All mediation proceedings are confidential. Parties shall not disclose the content of discussions, proposals, or concessions made during mediation to any person not involved in the proceedings. This obligation survives the termination of the mediation process.
Exceptions apply only where disclosure is required by law or where both parties provide written consent.
5. Prohibited Conduct
The following conduct is strictly prohibited on the platform:
- Filing fraudulent or vexatious claims.
- Submitting false, fabricated, or misleading evidence or information.
- Impersonating another individual or entity.
- Attempting to contact the opposing party outside the platform to influence or intimidate them regarding the dispute.
- Engaging in any form of harassment, threats, or coercion.
- Attempting to bribe or unduly influence a mediator.
6. Grounds for Removal or Suspension
iResolve.legal reserves the right to suspend or remove any participant (including mediators) who:
- Violates this Code of Conduct.
- Engages in conduct that undermines the integrity of the mediation process.
- Fails to comply with platform rules or the terms of their registration.
- Is found to have submitted false information during registration or claim filing.
Actions may include warnings, temporary suspension, permanent removal from the platform, and reporting to relevant authorities where applicable.
7. Complaints
Any participant who believes another party or mediator has violated this Code of Conduct may file a complaint by contacting support@iresolve.legal. All complaints will be reviewed by the platform administration and addressed promptly.
8. Amendments
iResolve.legal reserves the right to update this Code of Conduct at any time. Participants will be notified of material changes via email or platform notification. Continued use of the platform after such changes constitutes acceptance of the updated Code of Conduct.
